GENERAL TERMS AND CONDITIONS
These general terms and conditions (the “Terms of Sale”) govern the offer and sale through the marcotadini.com website (the “Site”) of products marked by the brands of which we are legally distributors.
The sale of products through the Site is intended solely and exclusively at the request of Customers who are qualified as “Consumers” in accordance with Legislative Decree No. 206 of September 6, 2005 (the “Customers”). Therefore, the Seller reserves the right not to process orders from parties other than Consumers or who do not comply with its commercial policy.
If one or more sales are made to a person who cannot be qualified as a “Consumer”, the following Terms of Sale will apply but, despite the provisions thereof, the buyer will not benefit from the right of withdrawal in accordance with art. 26 et seq., the buyer will not be able to benefit from the warranty on the products and will not benefit from any other protection, provided here in favor of the “Consumer”, which reflects or complies with the mandatory provisions of the law.
The Terms of Sale do not govern the provision of services or the sale of products by third parties other than the Seller, which may be present on the Site or accessible via links, banners or other hyperlinks, for which the Seller assumes no responsibility.
To make purchases via the Site, the customer must be of legal age (18 years old) and have the capacity to act, which the customer declares to have.
The Seller also declines any responsibility in the event that, due to a malfunction of a particular configuration of the computer used by the customer, due to changes in the light of the monitor, the colors of the products displayed on the website do not faithfully reflect the original colors, but have slight differences from the published items.
Any color difference between the leather and the Pantone colors used on the site is due to the fact that the colors may vary depending on the instrument from which they are displayed.
CONCLUSION OF THE CONTRACT
To conclude the contract for the purchase of one or more products on the Site, customers must complete the order form in electronic format and send it to the seller, electronically, following the instructions in the appropriate box.
The order box will include: a summary of information on the essential characteristics of the product ordered, the price (including applicable taxes or duties), the means of payment that can be used, the methods of delivery of the products, the shipping and delivery costs as well as the conditions for exercising the right of withdrawal, the methods and deadlines for returning the products.
The contract is concluded when the seller receives the completed order form electronically, after verifying the accuracy of the data entered and accepting the Terms and Conditions of Sale. The order form will be archived for the period necessary for the processing of the orders and in any case in compliance with the legal provisions.
Once the contract has been concluded and the purchase order has been processed, the seller will send an email receipt of the purchase with the information already contained in the form.
The seller may refuse to process orders that do not sufficiently guarantee the customer’s creditworthiness or that are incomplete or incorrect.
UNAVAILABILITY OF PRODUCTS
If the products presented on the site are no longer available or for sale at the time the Client submits the form, the Seller must promptly inform the Seller and, in any case, within five (5) days from the day following the day on which the order was sent to the Seller, of any unavailability of the products ordered. In the event of payment, the Seller will immediately refund the amount advanced by the Client.
WARRANTY AND INDICATION OF THE PRICE OF THE PRODUCTS
